To avoid disputes on public jobs, ‘tell it like it is’

Experts at Construction Dive’s event emphasized that early, frequent and honest communication is the best way to prevent disputes in large public construction projects. They highlighted the benefits of using the progressive design-build method, which encourages collaboration and transparency between all stakeholders from the start. This approach allows design and construction to overlap, helping projects begin sooner and adapt more easily to challenges. Panelists noted that while the federal government faces delays from supply chain issues and inflation, many state and local governments continue to push major infrastructure projects forward, with about $500 billion worth of mega projects in progress nationwide.

Speakers agreed that most project delays stem from design errors, scope changes and poor information sharing, problems that can extend timelines by over a year. They stressed that open dialogue and teamwork help control costs and minimize risks. Examples like the San Diego International Airport Terminal 1 project showed that collaboration between designers, contractors and owners can keep work moving even under difficult conditions. Ultimately, panelists concluded that no contract can prevent every dispute; the key to success lies in direct, transparent communication and a willingness to “tell it like it is.”
